German Court Rebuffed Sanofi’s Challenge against Acomplia’s Non–Compensation

Sanofi-Aventis’s legal challenge against the German government's decision to categorize Acomplia as a non-reimbursable medicine has been rejected by the Social Affairs Court in Berlin, according to a company spokesman.
The court offered a synopsis of its ruling last week in a reply to the French drug maker’s request that the German government's verdict should be debarred.
The spokesman alleged that Sanofi now has four weeks time to make a final decision whether to appeal this verdict or not.
He further added that the same court is performing an in-depth evaluation of Sanofi's appeal against Acomplia's non-reimbursement. In January, the German ministry of health accepted the proposal of the German Federal Joint Committee to incorporate diet drug acomplia below the class of lifestyle treatment under section 34 of the 'social code'.
Sanofi argued that Acomplia must be sheltered by the state health insurance programme as it lends aid to lower the possibility of diabetes and heart disease, in addition to its proven help for weight loss.
